Did You Retire on Disability but Want to Go Back to Work?

Government Code section 21233 prohibits a member who has retired for disability from being employed as a retired annuitant in the same position from which they retired, or in a position that includes duties or activities that the person was previously restricted from performing at the time of disability retirement.

If you retired on a disability or industrial disability retirement, you’ll want to know about a new law that became effective January 1, 2020. Government Code section 21233 prohibits a member who has retired for disability from being employed as a retired annuitant in the same position from which they retired, or in a position that includes duties or activities that the person was previously restricted from performing at the time of disability retirement.

If you are a disability retiree and are currently working in a retired annuitant position, be sure you are not working in violation of this government code.
