Previously, any CalPERS members with a community property hold — even those who fully resolved their case — were not able to apply for retirement online.
Make sure to resolve the community property claim on your account as soon as possible. We will not release any retirement, health, or dental benefits until the claim is resolved. However, if you are ready to retire, do not delay submitting the application until the claim is resolved. Your application must be received within nine months of separation from employment to ensure you receive the earliest retirement date and other benefits that you may be entitled to.
For information about the different methods of division and basic community property questions, you can review the publications A Guide to CalPERS Community Property (PUB 38A) (PDF) and CalPERS Model Domestic Relations Orders (PUB 38B) (PDF).
With the latest update to my|CalPERS, you can now apply for retirement by logging in to your my|CalPERS account.
